Press Release – New York, NY – April 19, 2019 – Sichenzia Ross Ference LLP (SRF) attorney Mendy Piekarski achieves a complete dismissal of a lawsuit on behalf of numerous defendants. Plaintiffs alleged that defendants, specialty finance lenders, induced plaintiffs’ clients to default on their contracts and encouraged the clients to sue plaintiffs.
The New York Supreme Court granted SRF’s motion to dismiss the lawsuit because, among other things, SRF demonstrated that the plaintiffs failed to identify a specific instance of the defendants inducing a breach of contract and, moreover, that the alleged conduct did not constitute tortious interference as a matter of law. The court dismissed the complaint in its entirety. Earlier in the case, SRF defeated plaintiffs’ motion for a preliminary injunction against defendants, prevailing upon the court to rule that plaintiffs were not likely to succeed in the litigation.
